SELF STORAGE AGREEMENT

(Consumer Contract – England & Wales)

This Agreement sets out the terms on which Store In My Space (“we”, “us”, “our”) provide storage services to you as a consumer (“you”, “your”).

Please read these terms carefully before signing or booking.

1. Status of This Agreement

1.1 This is a consumer contract.
1.2 Nothing in this Agreement affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer legislation.
1.3 If any term is found to be unfair or unenforceable, the remaining terms shall continue to apply.

2. Our Services

2.1 We grant you a personal licence to use the Storage Unit for storing your goods.
2.2 This Agreement does not create a lease or tenancy and does not give you exclusive possession.
2.3 We will provide the service:

  • With reasonable care and skill (as required by law);
  • In accordance with the information provided before you entered into this Agreement.

3. Term and Cancellation Rights

3.1 Minimum Term

If a minimum storage period applies, this will be clearly stated in your Order Form.

3.2 Consumer Cancellation Rights (Distance or Off-Premises Contracts)

If you enter into this Agreement online, by phone, or off-premises, you have the right to cancel within 14 days without giving any reason.

  • The cancellation period expires 14 days after the date of the contract.
  • To cancel, you must inform us of your decision in writing (email is acceptable).

If you request that storage begins during the 14-day cancellation period:

  • You must pay for services provided up to the date of cancellation;
  • Once the service has been fully performed (for example, where the unit has been used and vacated), you may lose the right to cancel.

4. Fees and Price Transparency

4.1 All Fees will be clearly stated before you enter into this Agreement.
4.2 Fees must be paid in advance.
4.3 We may increase Fees only by giving at least 30 days’ written notice.
4.4 If you do not agree to a price increase, you may terminate the Agreement before the increase takes effect without penalty.

We will not charge hidden fees or undisclosed additional charges.

5. Access to the Storage Unit

5.1 You may access your unit during published access hours.
5.2 We may temporarily suspend access:

  • For repairs, maintenance or safety reasons;
  • If payment is overdue (see Clause 11).

Any restriction will be proportionate and lawful.

6. Your Responsibilities

You agree:

6.1 To store only lawful goods that you own or are entitled to store;
6.2 To ensure goods are safely and securely packed;
6.3 Not to use the unit for residential purposes or business activity without written consent;
6.4 To comply with health, safety and fire regulations.

7. Insurance and Risk

7.1 Your goods are stored at your own risk unless loss or damage is caused by our negligence or breach of contract.
7.2 We strongly recommend you maintain adequate insurance cover.
7.3 If we offer insurance, key terms and exclusions will be clearly explained before purchase.

We do not exclude liability where it would be unlawful to do so.

8. Prohibited and Restricted Goods

You must not store:

(a) Hazardous, flammable, explosive or combustible materials (including fuels, gas cylinders, fireworks, chemicals or solvents);
(b) Illegal goods, stolen items or counterfeit goods;
(c) Toxic, radioactive, contaminated or biohazardous materials;
(d) Firearms, ammunition or weapons;
(e) Live animals or perishable goods;
(f) Items that emit fumes, odours, or may cause nuisance, contamination or infestation.

Unless agreed in writing, you must not store:

  • Cash, currency or securities;
  • High-value jewellery or artwork;
  • Important legal or personal documents;
  • Items of exceptional sentimental value.

If prohibited goods are stored, we may require their immediate removal and may notify appropriate authorities where legally required.

9. Our Liability

9.1 We are responsible for loss or damage to your goods only where caused by our negligence, breach of contract, or failure to provide services with reasonable care and skill.
9.2 We do not exclude or limit liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation;
  • Any matter where exclusion would be unlawful.

9.3 Where liability arises, it shall be limited to the lower of:

  • The actual value of the goods; or
  • The maximum value declared by you.

This limitation does not apply where it would be unfair under consumer law.

10. Right of Entry

10.1 We may enter the unit:

  • In emergencies;
  • Where required by law;
  • If we reasonably suspect breach of this Agreement.

Where possible, reasonable notice will be given.

11. Late Payment and Lien

11.1 If payment is overdue, we may:

  • Suspend access to the unit;
  • Apply reasonable late payment charges (clearly stated in advance).

11.2 We have a contractual lien over stored goods for unpaid Fees.
11.3 If payment remains outstanding, we may sell goods only:

  • After giving written notice;
  • In accordance with applicable law;
  • Using proceeds first to cover unpaid Fees and reasonable costs;
  • Returning any surplus to you.

This clause is intended to be fair and proportionate.

12. Termination

12.1 You may terminate this Agreement by giving at least 14 days’ notice (unless otherwise agreed).
12.2 We may terminate for serious breach or persistent non-payment.
12.3 On termination, you must remove all goods and leave the unit in good condition.

13. Complaints

If you are unhappy with our service, please contact us using the details provided.
If a dispute cannot be resolved, you may have the right to use Alternative Dispute Resolution (ADR).

14. Data Protection

We process your personal data in accordance with UK data protection legislation, including the UK GDPR and Data Protection Act 2018.

PROHIBITED GOODS AND RESTRICTED ITEMS

1. Prohibited Goods

The Customer shall not store, nor permit any third party to store, any of the following items (“Prohibited Goods”) within the storage unit:

1.1 Hazardous or Flammable Materials
Any materials that are hazardous, combustible, explosive, flammable or otherwise dangerous, including but not limited to petrol, diesel, fuels, oils, gas cylinders, compressed gases, fireworks, explosives, solvents, paints, thinners, chemicals, or cleaning agents.

1.2 Illegal or Unlawful Goods
Any goods which are illegal to possess, store, distribute or manufacture under applicable law, including stolen goods, counterfeit goods, illicit substances, or items connected with criminal activity.

1.3 Toxic, Contaminated or Biohazardous Materials
Any materials which are toxic, radioactive, contaminated, infectious, hazardous waste, asbestos, or otherwise pose a risk to health, safety, property or the environment.

1.4 Weapons and Ammunition
Firearms, ammunition, explosives, weapons of any description, or any component parts thereof.

1.5 Living Creatures or Biological Matter
Any live animals, plants, insects, perishable biological matter, or any goods which require environmental control, care, or maintenance.

1.6 Perishable Goods
Food, drink, or any other perishable items which may decay, spoil, emit odours, attract vermin, or cause nuisance or contamination.

1.7 Nuisance or Contaminating Items
Any goods which emit fumes, odours, noise, or radiation, or which may cause damage, infestation, contamination, or nuisance to the facility or other customers’ property.

2. Restricted or Excluded Items

Unless expressly agreed in writing by Store In My Space, the Customer shall not store:

2.1 Cash, currency, bullion, coins, securities, or negotiable instruments.
2.2 Jewellery, precious stones, furs, works of art, antiques, or other high-value items.
2.3 Important legal, financial, or personal documents (including but not limited to wills, deeds, passports, or certificates).
2.4 Items of exceptional sentimental value.

Where permitted, such items shall remain entirely at the Customer’s risk and may be excluded from any insurance cover provided or arranged by Store In My Space.

3. Customer Warranties

The Customer warrants that:

3.1 The goods stored do not include any Prohibited Goods.
3.2 The goods are the Customer’s lawful property or are in the Customer’s lawful possession.
3.3 The storage of the goods will not breach any applicable law or regulation.

4. Breach

If Store In My Space reasonably suspects the presence of Prohibited Goods:

4.1 The Company reserves the right to refuse storage, deny access to the unit, or require immediate removal of the goods.
4.2 The Company may take such steps as are reasonably necessary to protect persons, property, or the environment, including notifying relevant authorities.
4.3 The Customer shall indemnify Store In My Space against all loss, damage, liability, costs, and expenses arising from any breach of this clause.
